Apple, Foxconn set new standard for Chinese workers

SAN FRANCISCO (Reuters) - Apple Inc and its main contract manufacturing Foxconn agreed to tackle violations of conditions among the 1.2 million workers assembling iPhones and iPads in a landmark decision that could change the way Western companies do business in China.

Taiwan's Foxconn Technology Group, whose subsidiary Hon Hai Precision Industry assembles Apple devices in factories in China, will hire tens of thousands of new workers, eliminate illegal overtime, improve safety protocols and upgrade workers' housing and other amenities.

It is a response to one of the largest investigations ever conducted of a U.S. company's operations outside of America. Apple had agreed to the probe by the independent Fair Labor Association (FLA) to stem a crescendo of criticism that its products were built on the backs of mistreated Chinese workers.

The association, in disclosing its findings from a survey of three Foxconn plants and over 35,000 workers, said it had unearthed multiple violations of labor law, including extreme hours and unpaid overtime.

FLA President Auret van Heerden expects the agreement between Apple, the world's most valuable listed company, and Foxconn, which supplies 50 percent of the world's consumer electronics, to have far reaching affects.

"Apple and Foxconn are obviously the two biggest players in this sector," he said in an interview. "Since they're teaming up to drive this change, I really do think they set the bar for the rest of the sector."

That could affect brand names that have contracts with the Taiwanese company, including Dell Inc, Hewlett-Packard, Amazon.com Inc, Motorola Mobility Holdings, Nokia Oyj and Sony Corp.

The agreement is a sign of the increasing power of Chinese workers to command higher wages given increasing prices in China, and an ageing workforce that has led to labor shortages.

"Foxconn is proposing this better deal," said van Heerden. "Their competitors will be obliged to offer a similar package just in order to get enough workers."

Working conditions at many Chinese factories supplying Western brands are considerably inferior to those at Foxconn, experts say.

Still, labor costs are a fraction of the total cost of most high-tech devices, so consumers might not see higher prices.

"If Foxconn's labor cost goes up ... that will be an industry-wide phenomenon and then we have to decide how much do we pass on to our customers versus how much cost do we absorb," HP Chief Executive Meg Whitman told Reuters in February.

Under the agreement, Foxconn said it will reduce working hours to 49 per week, including overtime, while keeping total compensation for workers at its current level. The FLA audit found workers in the three factories put in more than 60 hours per week on average during peak production periods.

To keep up with demand, Foxconn will hire tens of thousands of additional workers and build more housing and canteens.

Apple CEO Tim Cook, who took over from the late co-founder Steve Jobs last year, has shown a willingness to tackle the criticism head-on.

"We fully support their recommendations," an Apple spokesman said. "We share the FLA's goal of improving lives and raising the bar for manufacturing companies everywhere."

But New York-based labor advocacy group China Labor Watch said the report failed to address the workers' primary concerns.

"Until Apple shares a larger proportion of its profits with its supplier factories, workers will receive the same pittance for a salary while working around the clock," Li Qiang, the director of China Labor Watch, said in an emailed statement.

The agreement has not gone down well with some Foxconn workers, either.

Chen Yamei, 25, who has worked at a Foxconn factory at Longhua in southern Guangdong province for four years, complained that her salary will drop to just over 2,000 yuan a month ($317) from over 4,000 yuan.

"We are here to work and not to play," she said. "Our income is very important." Another worker was less concerned.

"Working here is just so-so. Working conditions and the pay are all right," said Li Wei, a 20-year-old who has worked at the Foxconn factory for about a year.

"However there are around 100,000 people in there, so sometimes the feeling can be oppressive," Li said, who works eight hours, or a maximum 10 hours, a day.

Hon Hai shares fell on Friday around 1.3 percent, underperforming a rising market. Apple shares, which hit a record high on Wednesday, dropped 1.3 percent on Thursday.

The report marks the first phase of a probe into Apple's contract manufacturers across the world's most populous nation.

Foreign firms have long grappled with working conditions in China, dubbed the world's factory because of its low wages and efficient coastal transport and shipping infrastructure.

Global protests against Apple swelled after reports spread in 2010 of a string or suicides at Foxconn's plants in southern China, blamed on inhumane working conditions and the alienation that migrant laborers, often from impoverished provinces, face in a bustling metropolis like Shenzhen, where two of the three factories the FLA inspected are located.

Some have also criticized the FLA for its close alignment with corporations.

The FLA will conduct onsite verification visits to make sure the agreement is implemented, van Heerden said.

Apple is not the first U.S. consumer brand to respond to criticism of working conditions at factories abroad making its products.

Nike Inc implemented wide-ranging changes to improve safety and working conditions after it was rocked by reports in the 1990s that its contractors in China and elsewhere forced employees to work in slave-like conditions for a pittance.

Yet even Nike stopped short of Apple's and Foxconn's hiring and income-boosting spree. Last month, Foxconn said it was raising salaries by 16 to 25 percent, and was advertising a basic monthly wage, not including overtime, of 1,800 yuan ($290) in the southern city of Shenzhen, Guangdong province - where the monthly minimum wage is 1,500 yuan.

Future forays by the FLA over coming months will encompass Apple contractors Quanta Computer Inc, Pegatron Corp, Wintek Corp and other suppliers, all notoriously tight-lipped about their operations.

Rather than focus on the article of clothing that Trayvon was wearing when he was gunned down, Mississippi rapper and producer David Banner looked at what he feels is the deeper issue. "America is showing young black men: If you don't make us comfortable around you, we will kill you," he told MTV News on March 29. "As much as people don't want to admit it, that's what this is about."

Banner urged Martin supporters to not focus on the clothes Martin was wearing, but rather the issue at large. Hoodie or not, he said black men are often the target, citing the 2009 police shooting of Oscar Grant and the 1991 LAPD beating of Rodney King as examples.

Instead, Banner urges demonstrators to focus their energy to change legislation that ensures that young black men like Martin are protected from corrupt police and overzealous authority figures. "If we don't find what that is after this is no longer a trending topic, then we just lost another child again," he said.

So far, conventional solutions to global warming ? new government policies and changes in individual behavior ? haven't delivered. And more radical options, such as pumping sulfur into the atmosphere to counteract warming, pose a great deal of risk.

There may be another route to avoid the potentially disastrous effects of climate change : We can deliberately alter ourselves, three researchers suggest.

Human engineering, as they call it, poses less danger than altering our planet through geoengineering, and it could augment changes to personal behavior or policies to mitigate climate change, they write in an article to be published in the journal Ethics, Policy and the Environment.

"We are serious philosophers, but we might not be entirely serious that people should be doing this," said Anders Sandberg, one of the authors and an ethicist at Oxford University in the United Kingdom. Their suggestions
In their article, they put forward a series of suggestions, intended as examples of the sorts of human engineering measures that people could voluntarily adopt. These include:

  • Induce intolerance to red meat (think lactose intolerance), since livestock farming accounts for a significant portion of greenhouse gas emissions.
  • Make humans smaller to reduce the amount of energy we each need to consume. This could be done by selecting smaller embryos through preimplantation genetic diagnosis, a technique already in use to screen for genetic diseases. "Human engineering could therefore give people the choice between having a greater number of smaller children or a smaller number of larger children," they write.
  • Reduce birthrates by making people smarter, since higher cognitive ability appears linked to lower birthrates. This could be achieved through a variety of means, including better schooling, electrical stimulation of the brain and drugs designed to improve cognitive ability, they propose.
  • Treat people with hormones, such as oxytocin, to make us more altruistic and empathetic. As a result, people would be more willing to act as a group and more sensitive to the suffering of animals and other people caused by climate change.

Engineering the Earth
Frustration with the gap between measures to address climate change and rising greenhouse gas emissions has prompted a colorful array of geoengineering, or planet-altering, solutions. These include pumping sulfur particles or other aerosols into the atmosphere to reflect the sun's warmth back out into space; seeding the oceans with iron to prompt algal blooms that would, in theory, suck carbon out of the atmosphere and eventually tuck it away in the seafloor; and perhaps most realistically, pumping the excess carbon into reservoirs and storing it there.

In general, these solutions are problematic because they cannot be ground-tested before being implemented, and once implemented, the effects would be global, according to Sandberg.

"If I want to test out one of those brain-enhancing devices, I can test it on medical students. If something goes wrong, I might get a lawsuit, but it is a localized problem. How do you test geoengineering ?" Sandberg said. "How many Earths do we have to test on?"

What's more, a change that benefits one country may hurt another, he said.

"Someone will tell you, 'I think it's horrible people take pills to become smarter,' but they are saying it over coffee," he said alluding to the alertness-enhancing effects of caffeine in the coffee. Supplementing salt with iodine is credited with preventing brain damage in infants, and as a result, boosting intelligence around the world.

I think it's most likely green changes to human nature aren't anything we have thought of."

?We announced this because our customers requested it,? says Zack Hutson, a spokesman for Starbucks. He?says the company wants to provide a ?transition? environment,?where customers can ?relax and?connect? on their way home from work.

?The feedback from our Seattle coffeehouses have been very positive,? he adds.

But responses from both?advocacy groups as well as customers at non-alcoholic locations in southern California suggest that not?everyone approves.

?This is just a way for Starbucks to turn into bar bucks,? says Michael Scippa, public affairs director for Alcohol Justice, a northern California non-profit?based in San?Rafael that seeks to protect communities from ?the alcohol industry?s harmful practices.??He points to?what he calls the sobering statistics on alcohol-related damage, including everything from spousal abuse to driving fatalities and?incarceration costs for DUI-related crimes. His?group conducted a study four years ago that put that figure at some $38 billion annually.

The move to post wine and beer on the?daily menus alongside hot chocolate and milk ?normalizes alcohol consumption? in what has been up until now a very family friendly, social setting, Mr. Scippa says. ?We consider this a very damaging?message to send to young people who will see this when they come in with their friends and?parents,? he adds.?

Interviews with morning patrons at the corner Starbucks in Sherman Oaks, Calif., show mixed reactions, if slightly negative to the announcement that beer and wine?might soon be served.

Pentair and Tyco flow control business to combine

(AP) ? Diversified industrial company Pentair said Wednesday that it's combining its operations with Tyco's flow control business in an all-stock deal worth about $4.53 billion, uniting two of the biggest players in water and fluid products systems.

Under the terms of the deal, which is subject to shareholder approval, the combined company will retain the Pentair Inc. name and Pentair's CEO will remain in place. Two Tyco International Ltd. nominees will join the board.

Tyco shareholders will own about 52.5 percent of the combined company and Pentair shareholders will own about 47.5 percent, the companies said.

The news sent Pentair's shares up $6.95, or 17.3 percent, to $47.21 in morning trading, while Tyco International Ltd. shares rose $2.35, or 4.4 percent, to $55.87.

The move is part of plan announced by Tyco last year to break itself up into three independent companies, including one for flow control products. The business sells valves and controls for the energy, mining and water markets. It also designs and installs heat management systems for the energy and general process industries.

The deal with Pentair is subject to the completion of the breakup, which Tyco said it still expects to complete by September.

Pentair said the addition of Tyco's business will boost its global reach and give it greater access to developed and fast growth regions, while also allowing it to capitalize on growth trends in the energy, infrastructure and industrial sectors.

Minneapolis-based Pentair's water and fluid solutions business makes products and systems for use in the movement, storage and treatment of water for residential, industrial, commercial, municipal, and agricultural uses.

Pentair said it expects the deal to boost its 2013 adjusted profit by about 40 cents per share and help its annual profit pass $5 per share by 2015, largely as a result of cost cuts. At the same time, the company expects to incur about $230 million in one-time costs related to the deal over the next one to two years.

The combined company will be based in Switzerland, where Tyco is currently incorporated, with its main U.S. offices in Minnesota, where Pentair is based. It will have about 30,000 employees worldwide, with about half coming from each company.

The companies said the deal values Tyco's flow control business at $4.9 billion, including $275 million in debt and $94 million in minority interest.

New evidence on effects of green coffee beans in weight loss

ScienceDaily (Mar. 27, 2012) ? Scientists have just reported striking new evidence that green, or unroasted, coffee beans can produce a substantial decrease in body weight in a relatively short period of time.

In a study presented at the 243rd National Meeting & Exposition of the American Chemical Society (ACS), the world's largest scientific society, Joe Vinson, Ph.D., and colleagues described how a group of overweight or obese people who consumed a fraction of an ounce of ground green coffee beans each day lost about 10 percent of their body weight.

"Based on our results, taking multiple capsules of green coffee extract a day -- while eating a low-fat, healthful diet and exercising regularly -- appears to be a safe, effective, inexpensive way to lose weight," Vinson said at the ACS meeting, being held in San Diego the week of March 26.? He is with the University of Scranton in Pennsylvania.

The study involved 16 overweight or obese people aged 22-26 years who took capsules of the extract or capsules containing a placebo, an inactive powder, for a total of 22 weeks. The subjects alternated between a low dose and a higher dose of the extract. The low dose consisted of 700 mg of the coffee extract, and the high dose was 1,050 mg. It was a so-called "cross-over" study in which people cycled through the two doses and the placebo, each for six weeks. Such studies have advantages because each person serves as his or her own "control," improving the chances of getting an accurate result.

All of the participants were monitored for their overall diet (calories, food eaten, etc.) and exercise over the study period. "Their calories, carbohydrates, fats and protein intake did not change during the study, nor did their exercise regimen change," Vinson said.

Participants lost an average of 17 pounds during the 22 weeks of the study. It included an average of a 10.5 percent decrease in overall body weight and a 16 percent decrease in body fat. Vinson noted that weight loss might have been significantly faster, except that participants received the placebo and the lower dose of green coffee extract for part of the study period.

Vinson pointed out that previous studies have shown weight loss with green coffee. But this was the first to use higher amounts of the coffee extract and the first to measure the response to various doses. Based on those studies, Vinson believes that green coffee beans' effects likely are due to a substance called chlorogenic acid that is present in unroasted coffee beans. Chlorogenic acid breaks down when coffee beans are roasted (usually at a temperature of 464-482 degrees Fahrenheit). Roasting gives coffee beans their distinctive color, aroma and flavor. Green coffee beans, in contrast, have little aroma and a slightly bitter taste.

ScienceDaily (Mar. 25, 2012) ? Researchers at the Sahlgrenska Academy at the University of Gothenburg, Sweden, ?have discovered a previously unknown mechanism which helps intestinal bacteria to affect the formation of blood vessels. The results, which are presented in Nature, may provide future treatments of intestinal diseases and obesity.

There are ten times more bacteria in our intestines than cells in the human body. However, we know relatively little about how the normal gut microbiota functions and the resulting effects on our physiology.

Previously unknown mechanism

In a study of mice, researchers at the University of Gothenburg?s Sahlgrenska Academy have discovered a previously unknown mechanism by which gut microbiota influences intestinal physiology and blood vasculature remodelling. The results, which are published in the online version of the highly respected scientific journal Nature on 11 March, open up future opportunities to control the intestine?s absorption of nutrients, which in turn may be used to treat conditions such as intestinal diseases and obesity.

The study focuses on villi, finger-like projections which are about one millimetre long, and which increase the surface area of the intestine and maximise its ability to absorb nutrients. In the presence of bacteria, these villi become shorter and wider, which means that new blood vessels must be formed. However, the process involved has previously been unclear.

"Zip code"?for protein signals

?Our study shows that signals from the normal gut microbiota that induces blood vessel formation in the small intestine? says researcher Fredrik B?ckhed, who led the study at the Sahlgrenska Academy. ?In simplified terms, the intestinal bacteria promote the mucosal cells in the intestine to attach a sugar molecule to a specific protein. The sugar molecule acts like a zip code moving it to the cell surface where it induces signaling.

?It will take time before the results can be applied in a clinical context and converted into new therapies. But our discovery is exciting, and is a result of fundamental basic research which teaches us a great deal about how we live in cooperation with the normal gut microobiota.?

If those statistics look off-kilter, they should. The reality is that no one knows how many people are legally using marijuana in California because the state ? with hundreds of pot stores and clinics that issue medical marijuana recommendations ? does not require residents to register as patients. Of the 16 states that allow the medicinal use of cannabis, it is one of only three without such a requirement.

Now, with California's medical marijuana industry laboring under a renewed federal crackdown that has forced many storefront dispensaries to close, a state lawmaker has recently introduced legislation that, if passed, would give authorities a much clearer count of the drug's bona fide consumer base.

Sponsored by Assemblywoman Nora Campos, a San Jose Democrat, the bill would require anyone who wants to claim a legal right to use marijuana for health reasons to apply for a county-issued identification card. Marijuana patients also would have to say if they plan to grow their own pot or to purchase it from a patient collective, and name the collective.

The changes are designed to make it easier for police and sheriff's deputies to identify who can legally consume and grow marijuana and who is using medical marijuana laws as a cover for illegal drug possession or dealing, said Randy Perry, the Peace Officers Research Association of California lobbyist who wrote the bill.

"We are not saying people shouldn't be smoking it or eating it. The people have spoken, and that's legal," Perry said. "We are simply trying to organize it a little bit so our law enforcement officers won't have to arrest people who can legally have it and won't have to confiscate their legally grown marijuana plants when there is a lot of crime and a lot of criminals they need to be going after."

California already has a state-run medical marijuana patient database and program under which counties are required to issue ID cards to eligible patients. The program was adopted by lawmakers in 2003 as a way to protect legitimate medical patients from arrest when caught with marijuana in their cars. The registry system was seen as a way to add a measure of control to California's voter-approved law seven years earlier decriminalizing marijuana for medical use.

The registry was made voluntary, however, and relatively few patients have signed up. The California Department of Public Health reports that during the fiscal year that ended last June, the state had only 9,637 valid card holders.

In Colorado, by contrast, the state with a medical marijuana regime most similar to California's but where patient registration and annual renewal is mandatory, the total number of patients holding valid ID cards as of December was 82,089. If California's patients were registering at that rate, there would be more than 615,000 of them.

Medical marijuana-related businesses are ubiquitous in parts of California. But just three cards were issued for every 100,000 residents last year, putting the state below every state with a mandatory patient registry. New Mexico, with one of the most stringent medical marijuana laws, issued 21 cards for every 100,000.

In California, records show the pot growing region known as Emerald Triangle? Mendocino, Humboldt and Trinity counties? had among the highest rates of registrations in the state.

Health department officials declined to discuss the registry's unpopularity, but the reasons for it are hardly a mystery. Although the system was set up with extensive privacy protections, such as identifying patients by numbers instead of names, many people are reluctant to enter personal information on a government database since marijuana still is illegal under federal law.

Medical marijuana advocacy groups have done little to dispel the fears, and some doctors who specialize in writing marijuana recommendations have fueled confusion by providing plastic ID cards that many users mistakenly assume offer the same protections as the county-issued ones until they are in a traffic stop, said San Diego criminal defense lawyer Melissa Bobrow.

"I can understand the reluctance of patients to go on this list, but at the end of the day you want to think of the reality and what the worst-case scenario is," said Bobrow, who represents pot patients facing drug charges. "The world doesn't have the budget to go after everybody smoking marijuana in California, even in an economic boom. Is it possible the database could be breached? Anything is possible, but it is so unlikely why not give yourself that extra level of protection?"

The bill requiring California's pot patients to register is likely to meet fierce opposition from medical marijuana advocates, who have gone to court to block state and local laws limiting how many plants people can legally grow and regulations dictating where and how pot shops can operate.

Retired state Sen. John Vasconcellos, who sponsored the legislation creating the voluntary marijuana patient registry, predicted current lawmakers would be pre-empted from making the program mandatory, even if they approve the bill. The Legislature in his view cannot override voters who established at the ballot box that eligible patients only need a doctor's recommendation to be legal.

Vasconcellos ? himself on the marijuana registry? said he opposes making it mandatory. But he expressed surprise that so few Californians have availed themselves voluntarily of the "free pass" the system was supposed to provide. He was incredulous that in his own Santa Clara County there were at least 150 pot shops a year ago but only 198 residents with current registrations.

"I'm proud to have my card," he said, "and I'm saddened people don't feel like they can trust the integrity of the governmental process."
